Stephen M. Perry is a partner in Casner
& Edwards’ Litigation and Employment
Law areas. He handles a broad range of
matters, including employment and ERISA
cases, sophisticated business and commercial
disputes, and serious personal injury
matters. He has been recognized as a Massachusetts Super Lawyer® by Boston Magazine, an honor awarded to only five percent of the bar.
In the employment law area, Mr. Perry counsels
corporations and individuals regarding
such matters as employee terminations,
sexual harassment investigations, the
Family and Medical Leave Act, covenants
not to compete, and discrimination claims.
Mr. Perry has successfully defended corporations
against such claims in state and federal
courts and before the Massachusetts Commission
Against Discrimination and the Equal Employment
Opportunity Commission.
In his representation of individual claimants
in employment matters, Mr. Perry has achieved
a number of six and seven figure recoveries
and settlements, including
- a $9.5 million wrongful termination
settlement achieved after a two-week
trial and favorable jury verdict
- a $450,000 sexual harassment settlement
- a $475,000 age discrimination settlement
- numerous six-figure settlements under
disputed severance pay plans, in executive
employment contract disputes and under
disputed change-in-control contracts.
Mr. Perry has also handled numerous pension
and severance pay cases arising under
ERISA, including
- winning a 9.5 million class action
for severance pay at trial before
the United States District Court for
the District of Massachusetts, and
winning the subsequent appeal to the
United States Court of Appeals for
the First Circuit;
- serving as lead counsel in multi-plaintiff
litigation against a pension plan
leading to a recovery for the plaintiffs
of over $2 million;
- serving as plaintiffs’ lead
counsel throughout the discovery phase
of a $14 million ERISA action, including
briefing and arguing two appeals to
the United States Court of Appeals
for the Sixth Circuit.
In his personal injury practice, Mr. Perry
has successfully represented defendants
in a number of jury trials involving catastrophic
injuries, including defense verdicts against
plaintiffs who suffered traumatic brain
injuries or other serious injuries.
Mr. Perry has also handled in state and
federal courts a variety of commercial,
insurance coverage and business disputes,
including claims for breach of fiduciary
duty among family members and in close
corporations and various contract disputes
and business torts.
After obtaining a bachelor’s degree
from the Massachusetts Institute of Technology,
Mr. Perry received his J.D., magna
cum laude, from Harvard Law School,
where he was an editor of the Harvard
Law Review. He subsequently served as
law clerk to the late Bailey Aldrich,
of the United States Court of Appeals
for the First Circuit. Mr. Perry is a
member of the Massachusetts Bar Association. He is an avid runner and soccer player.
